Disney broke their contractual agreement in both cases. Both movies were made in like 2019 or so when theaters were doing great, Disney+ hadn't launched yet, and no one saw Covid coming. Because of this, their contracts were very specific. (at least in scarlett's case) that it was to be a Theatrical exclusive movie and her bonuses were tied to the box office performance, which was probably the same for Emma.
Again, Disney broke their contract and they have been unwilling to renegotiate according to Scarlett. I get that Covid happened, but a contract is a contract. They waited forever to release The New Mutants when they did because the Director had a Theatrical Exclusive clause in his contract, it should be no different here.
This is a mess created by the new orders by Chapek. I expect things will be handled behind closed doors as everything playing out in public like this is not good for Disney from a PR perspective. Hell, Disney's PR response about the lawsuit yesterday was trash. No one is going to feel bad for Disney.
