I understand what the contract purports to say (I haven't read that section personally, but I believe the second-hand reports of its contents), but if it's true, how did this rumor for WDW ever develop any legs? Multiple people have claimed they've heard Disney was considering it, but how would such a thing ever get by the legal department if that section of the contract means what it appears to mean?

There are only two conclusions I can draw (again, assuming the contract is what it is):
1. The rumor was flat-out untrue (read: made up) in the case of WDW.
2. Somebody within Disney thinks there's an "out" or a loophole, at least as it pertains to Guardians characters.

One other possibility is that it was being looked at by some Execs. for WDW at an early stage before legal was consulted. I'd imagine some of those people may not even be as knowledgeable as people on these sites when it comes to that contract.

I think EP 51 worked out well for the introductory on this, so it would be wise to have something more detailed in a blog..

Plus it's easier to go "here read this" than go "here listen to this, but jump to 15 minutes it then stop after 30 minutes and put up with the banter..."

I just want to point out that the Internet treats the Marvel/MCA Master Licensing Agreement thats been hanging around the internet for 20 years as the end-all-be-all gospel, but the reality is that we are not aware of 1) any possible addendums to the Agreement since then and 2) any interpretations of the Agreement by a judge that we are not privy to.

An example of #1 is that Disney could have went to Universal and been like, "Hey, we want to make a GOTG ride. We will give you XXX dollars. Let's add an addendum to the agreement that makes this exception". We wouldn't be privy to that information, but this happens all the time when unforseen circumstances arise and both parties can benefit from an addendum. Only a handful of lawyers at each entity would know if this has happened; we would not.

An example of #2 is that there could have been an arbitration where a judge interpreted some of the more vague parts (there aren't many) of the Agreement, e.g. what a "family" of characters is defined as, etc., which may have afforded some benefits to either party.

Chances are nothing like this has happened (especially noting Iger's dismissal of any Orlando Marvel activity at a recent meeting), but I just want to note that it *is* possible.

Wrong. Two amendments have been filed since writing the agreement.

1.) 1995 about paying fees First Amendment to Marvel Agreement

2.) After tWDC purchased to prevent them from seeing certain theme park figures. Link not available right now. Working on it.

As you said it's unlikely AND Universal and Disney have agreed the contract will not be changing.

You know whats funny & sad? Over on Magic, Disney fans have started a new thread that equates Universal's purchase of Dream Works with Universal's intent to sell Marvel rights back to Disney. These people just never give up their hopes for Marvel at WDW. :doh: And I always thought Loony Tunes were owned by Warner. I guess some Disney fans bought those rights. :lol:

My point here is that not every inter-company Agreement is available on the internet. We don't know what we don't know.

Ultimately we are living off scraps of information available to us here and there. None of us know with 100% certainty.

I may post on that site, but I am not nor will I ever affiliate myself with that specific group of morons. I didn't even know that thread existed. Let Universal keep Marvel. If the rumors of what Disney plans to do at DCA are true I'd like Marvel to stay in the amazing hands they're currently in east of the Mississippi.

FYI, not everyone there is like that. Plenty of saner heads.

Sure... But not with an already existing agreement that has shown it amends itself when something updates.

It's also possible that the whole deal was done while Marvel was crossing its fingers behind its back and is just waiting for the day before Hulk reopens to pull the contract away....

We have legal, predictable situations in front of us, the fact people choose to ignore it is there choice.

Yes, I agree with you Mike.There's actually a good number of thoughtful posters, many of them that post here also. :thumbsup: But they certainly do have that crazy for Disney fringe that lives in another world, far, far away. ;)

"Extraordinary claims call for extraordinary evidence."

What we're trying to say here, and eventually once the post goes up, is there's possible solutions and explanations for everything Disney has attempted. A lot make sense (why is it Super Hero HQ and Super Heroes Marathon Weekend? Read Section 10) while some are more murky (what about the hired hand Star Lord during the dance party?).

Also, if someone hasn't yet, give the contract a read. It's interesting and short and answers a lot of questions. Marvel Agreement between MCA Inc. and Marvel Entertainment Group
